Terms and Conditions

We ask you to agree to the following Terms and Conditions, which form the complete agreement between you, the "Guest", CleverDever Wherever (aka CleverDever Adventures), “The Company," as well as The Company's partner, the guiding and tour management company Private Guide Slovenia. Please read the following Terms and Conditions carefully. Each traveler must fill out and sign that you have fully accepted the Terms and Conditions for the Booking.  

Eligibility

You must be of legal drinking age in your country of residence and at least 21 years of age by the start of the tour.  

Passports and Other Documentation

You must obtain a valid passport and any other health and entry documentation (including any and all required Covid-19 vaccination documents to present to immigration and requesting tourism entities) that may be necessary for you to travel to the country of Slovenia. International travelers to Slovenia should possess a passport with at least three (3) months validity from the last date of travel within the country, six (6) months recommended. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the guest’s responsibility.

Trip Confirmation

The tour will be confirmed once it reaches the minimum number of guests. The minimum number of guests for Slovenia is 8. It is the Company’s objective to make this trip an intimate experience within Slovenia. As such, the number of guests will always be limited. The Company shall determine a minimum number of guests for each tour. If the minimum number of guests is not reached, the tour may be cancelled and any guests will have the option to move to another tour, hold funds for a future tour, or receive a refund minus the $395 deposit and admin fee.  

Each Guest is required to first fill out an application to ensure the Guest is a good fit for this tour. These are intimate experiences with a small number of travelers (no more than twelve) and Guests spend time with locals in their workshops and private homes. It is always the goal of the Company that each and every Guest have a wonderful experience on their trip, therefore we have a preliminary screening process to help both parties determine if they are a match. If it is decided that this is not the right tour for you, your deposit will be returned in full and you will be free to make other travel arrangements with other tour companies.

Policy and Fees for Cancellation of Bookings by Guests

A non-refundable deposit of $595USD is required to reserve your spot. Cancellation by the Guest must be made in writing (email is acceptable) to the Company and shall be subject to the following cancellation charges from the date the written cancellation is received.

  • Cancellations MORE than 120 days prior to departure of tour: Full refund minus $595 deposit
  • 119 - 61 days prior to departure: 50% refund
  • 60 or fewer days prior to departure: 100% of the tour cost

This policy also applies to pre-and post-tour extensions. (However, you may be able to recover all or part of your cancellation fee through your travel insurance policy.)

Arriving late or leaving a tour in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the tour.

Please note: Due to our up-front costs in organizing the trip, and pre-payment to hotels and local vendors we cannot refund your deposit (even if you wish to move to another tour) or additional funds paid once cancellation deadlines have passed. Trip insurance to cover illness (including the contracting of Covid-19), injury, family emergencies or commitments, financial hardship, or any other reason is strongly recommended and your only recourse to recover non-refundable payments.  

*COVID-19 Refund/Reschedule Policy 2022-2023*

CleverDever monitors covid-19 spikes and the overall safety of traveling on a tour-by-tour basis continually. This is a cultural immersion tour and we will be in local's homes or in close contact with them. Keeping hosts and guests safe and healthy is our first priority. We practice safe travel protocols adherent to the Adventure Travel Trade Association and each country's required guidelines.

If local government enacts travel restrictions either in your home country or the country of destination that force trip cancellations we will select a new date for your tour. If you opt out of the future trip, we will refund all payments less the $595 non-refundable deposit.

Trip insurance to cover illness (including the contracting of Covid-19), injury, family emergencies or commitments, financial hardship, or any other reason is strongly recommended and your only recourse to recover non-refundable payments.

Please note: if you are canceling due to verified government covid regulations, you CAN reschedule to preserve all trip funds. You may reschedule your tour to a future date within one year without penalty. If you prefer to cancel, please see the above deadlines to determine the amount of refund available to you.

Policy for Cancellation of Bookings by CleverDever Wherever

The Company will only cancel a paid Booking for force majeure events (e.g., Company personnel illnesses or emergencies, global health crises, acts of war or terrorism, extreme weather resulting in damage beyond repair to the area we're visiting, and actions by Guests reasonably deemed unprofessional or other circumstances that would bring undue hardship upon the Company). Such cancellation shall be made in writing (email is acceptable). In such cases, The Company and Guest agree to discuss the circumstances regarding a pending cancellation, however, The Company shall make the final decision regarding cancellation, non-cancellation, or a potential re-scheduling. You understand and agree that The Company may already have paid out non-refundable travel monies to vendors, suppliers, and local government entities and that the funds may not be recoverable. In this case, a full travel credit will apply for the same tour rescheduled at a later date.

CleverDever Adventures reserves the right to cancel any tour because of inadequate enrollment that makes the tour economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the guests.  

Pre and Post Tour Extensions

This policy also applies to pre-and post-tour extensions. (However, you may be able to recover all or part of your cancellation fee through your travel insurance policy.) 

Double Occupancy Cancellation

If a Guest obtained the double occupancy rate and a roommate cancels prior to 120 days before departure, we will make every effort to match the guest with a new roommate. If we cannot, the single supplement rate will apply. If a roommate cancels less than 120 days prior to departure, the company will cover the single supplement.

Participation in Tours

Downtime is important. I feel you. That's why I've scheduled a good amount of it into almost every day. But I understand that sometimes you still need some time to yourself or a morning off. Do it. I won't be offended at all, this is your trip and I want you to enjoy it your way.

Please know though, that any parts of the tour that you decide not to participate in, or any goods, tastings, or meals you opt-out of will not result in a price reduction. No refunds shall be given for any pre-booked accommodation, activities, tours, or any other pre-booked goods, meals, or services that are not utilized. If you do not want to follow the tour’s itinerary, no worries, but there are no refunds for any parts of the tour missed.  

Please note: Arriving late or leaving a tour in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the tour.

Guest-only policy: Please note that all tours are created, arranged, reserved, and paid for strictly for paid guests of each CleverDever Adventure. We cannot accommodate additional friends, family, work colleagues, or any other acquaintances on any segment, activity, meal, or walking tour. Please understand that all components of the tour are for fully paid, pre-booked travelers only.

Trip Insurance

Trip Insurance should be purchased as soon as the tour is confirmed. While the worldwide health concern and coverage is ever-changing, medical and evacuation insurance is still required.

Trip interruption insurance is highly recommended for any schedule irregularities or missed flights and lost baggage. This will also help in the event that you have to cancel for any other reason not related to COVID-19. Please use your preferred insurance provider or check out this analysis by Forbes for help in selecting the trip insurance that is right for you. 

Once Your Space is Confirmed

The Balance can be paid either in full or via a payment plan. You will be sent an invoice to pay according to the payment option you selected at the time of booking (either pay in full or payment plan)

For payment plan guests final payment is due no later than 60 days prior to departure.

Currency

All Booking prices are quoted in American dollars. The official currency in Slovenia is the Euro or EUR. There will be ample opportunity for you to use ATM machines in the region in order to obtain EUR currency for incidental expenditures. It is highly recommended that you only visit ATM machines that are affiliated with national banking institutions as ATMs marked "Euronet" and other independent ATM machines charge markup fees of up to 13% of your total withdrawal amount and not the indexed conversion rate of the date.

Original Documentation

An electronic scan or photo of any signed document or required health or travel documentation shall be deemed delivery of an original.  

Extra Night

Hotel fees: Original Booking covers all lodging as outlined in the tour itinerary. If a guest requests extra nights at the tour hotel either before or after the tour, fees for accommodation are handled directly with the hotel. If a guest needs early check-in due to an early morning flight, or desires extra nights either before or after the tour dates, the guest incurs cost per hotel policy. The Guest is responsible for all extra nights outside the included hotel nights covered by the tour.

Personal Conduct and Behavior

If in the Company’s discretion, your conduct or behavior is inappropriate for continuation once the tour has begun, we may choose to exclude you from participation in any part of the tour. Inappropriateness may include, without limitation, excessive drunkenness, rude or hateful speech or behavior to other guests or guides, and/or any behavior that, regardless of its cause, is unfitting or offensive or interferes with the delivery of the tour services, or may constitute a hazard of any type. In such case, the Company’s liability shall be strictly limited to a refund of the recoverable cost of any non-participated portion of the Booking. The Guest understands that very few, if any, costs are recoverable within 60 days of departure. Once the tour commences travel funds have already been provided to vendors, suppliers and tour personnel may not be recoverable.


 

Changes in Tour Itinerary by The Company

If due to unforeseen circumstances, any part of the tour has to be changed due to last-minute unavailability, the Company will substitute this part of the tour with an activity or object of equal value. Partial Refunds will not be made if there is a change in the tour. It is made at the discretion of the tour guide and company. We also know it can be a disappointment if it was something you were personally looking forward to. The Company wants nothing more than to stick to the original itinerary and for all Guests to be thrilled with each experience, so please understand that absolutely no one wants to avoid making changes more than us. If a change is made, we'll be disappointed too. But let's stay positive, shall we? There's probably something just as good or better in its place.

Vendors and Suppliers

Each of the Company’s vendors and suppliers who provide services as part of the Booking is carefully selected, independent entities and are not agents, employees, contractors, servants, partners, or joint ventures of the Company. You agree that the Company is not responsible for any liability caused directly or indirectly (e.g., errors, warranties, representations, breaches, negligence, or omissions) by any vendors or suppliers or any other party or occurrence not under the Company’s sole control.  

Published Information

Information, prices, and availability are published both on the Company’s owned and controlled website and on booking platforms not owned and controlled by The Company. All remain subject to change without notice. You agree that the Company is not responsible for any typographical errors, itinerary errors, or changes listed on any of the Company’s owned, controlled websites or independent booking platforms. The Company also reserves the right to fix any pricing mistakes and once these errors are shown in writing, you agree to pay the corrected amount.

Conflicts Between Terms and Conditions, Tour Date Request Form, and Itineraries

If there are any conflicts between these Terms and Conditions, the Tour Reservation Form, and the Itinerary, these Terms and Conditions shall apply. If any provisions of these Terms and Conditions or any parts thereof are found to be unlawful, invalid, or unenforceable, then that provision or part thereof shall be deemed severable and struck from these terms and shall not affect the validity and enforceability of any remaining provisions, which shall remain in full force and effect. No employee, agent, or representative of the Company has the authority to modify, waive, or alter any provision of these published Terms and Conditions.  

Physical Capacity for Participation

All guests must have the physical capacity to participate fully in the Company’s tour without any assistance from the hosts or other guests. Any important health, diet or disability (physical or mental) issues must be made known to the Company in writing or on the Traveler Information Form. The Company reserves the right to decline any person a Booking if it believes that it is not possible to guarantee the welfare of that person during the tour.

A Booking may be refused or canceled after the deposit or the full payment has been made. In such cases, the deposit amount or full payment shall be refunded less any transaction/cancellation fees incurred. It is necessary to be able to walk well to visit and enjoy the natural attractions of the Slovenian countryside and the historic centers of the Slovenian towns and villages. You should be able to walk or stroll for periods up to two to three hours, with short breaks. We strive to find the best boutique hotels in the best locations. In Slovenia that might mean that the hotel is in a pedestrian zone or in a location where the bus cannot pull up to the front door. European hotel rooms are often in very old buildings that were not originally hotels. You must be prepared to carry your own luggage for several blocks as well as up stairs. With outdoor walks within the National Parks, there is always the option to remain behind until the group is finished with the activity. The Company’s objective is to always ensure an enjoyable experience for you.

You are always welcome to take time off from the scheduled activities whenever you like. Due to the nature of the winding mountain roads in Slovenia, it is advisable to consult your health professional if you suffer from motion sickness of any kind. No refund shall be given for any pre-booked accommodation, transportation, guided tour, or other pre-booked services or other travel that is not utilized. The Company shall make reasonable efforts to accommodate the needs of all our Guests; however, travelers requiring special assistance for their personal needs must notify us at the time of Booking for a determination of what assistance can be reasonably provided. In cases where we cannot accommodate a Guest’s special needs, persons requiring this assistance must be accompanied by a companion who shall independently provide the needed assistance. In no instance shall contracted vendors or suppliers or the Company’s personnel physically lift or assist clients on to or off of transportation vehicles, up stairs, or in any other situation.  

Medical Authorization and Coverage

In the event that a Guest becomes sufficiently incapacitated as to be unable to direct his or her own care, and there is no one on the tour who can direct participant’s care, and the Company is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for the tour, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a duly licensed physician deemed competent to render the necessary care.

In addition, the Guest certifies that they have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.  

Baggage Requirements

We recommend no more than 1 suitcase (roller wheel type) plus one backpack per person. Please pack light and prepare to be mobile. If you cannot pack light, please understand that our personnel, hosts, and guides are not authorized to lift heavy or excess luggage for you. You are responsible for carrying, moving, and lifting all of your own personal items to get to hotels and transportation as well as up and down stairs.

Publicity Permission

CleverDever Wherever and its designated tour operator and tour leader reserve the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a Booking on a CleverDever Adventure, the participant agrees to allow his/her likeness to be used by the Company, CleverDever Wherever-authorized third parties, and the tour operator without compensation to the participant. If the guest prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the tour. If, at any time, there is a particular photo, video, or recording that you wish The Company not to use, please notify us in writing.

Copyright in all photographs, video, and related materials created by the guests shall belong to the guest upon creation. The guest grants to CleverDever Wherever a non-exclusive, worldwide, irrevocable license to use any tour materials provided to CleverDever Wherever and/or the tour operator in any media for the following limited purposes: editorial use, promotion of this editorial use, or the promotion of CleverDever Wherever. No video may be taken or posted online of Juliana Dever aka CleverDever at any time without her express permission beforehand.  

Claims and Liabilities

The Company relies on the principles of the International Conventions, which may apply to the services provided by Company, our vendors, suppliers or agents with respect to any claim or any nature brought by you against the Company as a result of the provision of those services. International Conventions which apply may include: the International Convention on Travel Contracts (CCV Brussels, April 23, 1970), the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels and the California Travel Consumer Restitution Corporation. We will defer to these conventions regarding any limitations on liability in relation to any claim for death, injury, loss, damage, and delay to passengers and luggage. In no event, shall the Company be liable for anything other than compensatory damages and you hereby waive expressly and knowingly any right to incidental, consequential, and punitive damages. You agree to indemnify and hold the Company harmless from and against any costs, damages, losses, or liabilities arising out of your or your family’s or your companions’ own acts of negligence.  

Governing Venue

Any action or claim at law or in equity arising out of or relating directly or indirectly to the Booking and to these Terms and Conditions shall be governed by the laws of Slovenia without regard to any conflict of law’s provisions. You agree to file any such action or claim only in the courts located in Ljubljana, Slovenia and you hereby agree to such venue and consent and submit to the personal jurisdiction of such courts for the purposes of litigating any action or claim.  

Complete Agreement

The Terms and Conditions detailed herein contain the entire understanding and Agreement between you and the Company. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
