Terms and Conditions

We ask you to agree to the following Terms and Conditions, which form the complete agreement between you, Swivel Tail Productions (aka CleverDever Adventures), “The Company.” Please read the following Terms and Conditions carefully. Once you have submitted your deposit/payment for your Booking, you will receive a Traveler Information Form, which includes a copy of these Terms and Conditions. Each traveler must fill out and sign that you have fully accepted the Terms and Conditions for the Booking.  

Eligibility

You must be at least 18 years of age by the start date of the tour.  

Passports and Other Documentation

You must obtain a valid passport and any other health and entry documentation that may be necessary for you to travel to the Republic of Georgia. International travelers to The Republic of Georgia should possess a passport with at least three (3) months validity, six (6) months recommended. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the guest’s responsibility.  

Terms of Payment

A deposit of 25% of total Booking cost is due at time of Booking confirmation. Deposit, or, if you have paid in full at time of booking, is fully refundable for the first 24 hours. Your deposit must be received through our booking site via credit card in order to complete confirmation of Booking. Balance of payment shall be due 120 days prior to trip start date. A guest’s reservation may be canceled if full payment has not been received by 120 days prior to departure. For reservations made within 120 days of the departure date, full payment is required when the reservation is accepted.  

Items Not Included in Full Payment

 As indicated in the Frequently Asked Questions section of our website, our tour price does not include flights, extra beverages beyond those provided by Company. We do, however, include wine, water and coffee with most meals. As appropriate, it is your responsibility to ensure settlement of all charges made to any facility or provider of any service, for extra services requested directly by you. Such items might include tips, telephone charges, and Internet charges, mini bar items, a day spa, laundry, or items of a personal nature.  

Currency

All Booking prices are quoted in American dollars. The official currency in Georgia is the LARI. There will be ample opportunity for you to use ATM machines in the region in order to obtain GEL currency for incidental expenditures.  

Original Documentation

Electronic scan or photo of any signed document shall be deemed delivery of an original.  

Policy for Cancellation of Bookings by Company

The Company will only cancel a paid Booking for force majeure events (e.g., Company personnel illnesses or emergencies, acts of war or terrorism, actions by Guests reasonably deemed unprofessional or other circumstances that would bring undue hardship upon the Company). Such cancellation shall be made in writing (email is acceptable). In such cases, the Company and you agree to discuss the circumstances regarding a pending cancellation however; the Company shall make the final decision regarding cancellation, non-cancellation or a potential re-scheduling. You understand and agree that the Company’s sole responsibility and liability in the case of cancellation shall be a full refund of all monies paid in the purchase of the Booking through the Company. CleverDever Adventures reserves the right to cancel any tour because of inadequate enrollment that makes the tour economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the guests.  

Policy and Fees for Cancellation of Bookings by Guests

A cancellation by you must be made in writing (email is acceptable) to the Company, and shall be subject to the following cancellation charges from the date the written cancellation is received. Cancellations received more than 120 days prior to departure shall incur a loss of deposit (25% of total Booking cost). Per-person charges for cancellations that occur less than 120 days prior to departure (“Cancellation Penalty Period”) are as follows: 45-119 days prior to departure: 50% of total Booking cost; 44 or fewer days prior to departure: 100% of the tour cost. This policy also applies to pre- and post-tour extensions. (However, you may be able to recover all or part of your cancellation fee through your travel insurance policy.) If a guest obtained the double occupancy rate and a roomate cancels prior to 120 days before departure, we will make every effort to match the guest with a new roommate. If we cannot, the single supplement rate will apply. If a roomate cancels less than 120 days prior to departure, the company will cover the single supplement.

Arriving late or leaving a tour in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the tour.  

Extra Night

Hotel fees Original Booking covers all lodging as outlined in tour itinerary. If guest requests extra nights in a hotel either before or after tour, fees for accommodation are agreed upon before booking. If guest needs early check in due to early morning flight, guest incurs cost per hotel policy. Guest is responsible for cost of early morning check in.

Travel Insurance Purchasing Trip Cancellation Insurance and Interruption Insurance (and any additional Health Insurance, if needed) to protect you against financial loss from unforeseen accidents, illness, and/or loss of baggage, is your responsibility and strongly recommended. Please wait to purchase insurance until such time as you are certain of travel dates, and have communicated and confirmed your trip with CleverDever Adventures. World Nomads and Allianz have comprehensive policies available online or you can obtain and compare Travel Insurance quotes at Consumer Advocates.  

Personal Conduct and Behavior

If, in the Company’s discretion, your conduct or behavior is inappropriate for continuation once the tour has begun, we may choose to exclude you from participation in any part of the tour. Inappropriateness may include, without limitation, excessive drunkenness, any behavior that, regardless of its cause, is unfitting or offensive or interferes with the delivery of the tour services, or may constitute a hazard of any type. In such case, the Company’s liability shall be strictly limited to a refund of the recoverable cost of any non-participated portion of the Booking.  

Participation in Tours

You may decide not to participate in certain parts of the Company’s tour or not to utilize certain goods included in the tour. No refunds shall be given for any pre-booked accommodation, coach tours or other pre-booked goods or services or other travel, which is not utilized. Guests who do not want to follow the tour’s itinerary shall not be entitled to refunds for any parts of the tour missed.  

Changes in tour by company

If, due to unforeseen circumstances, any part of the tour has to be changed due to last minute unavailability, the Company will substitute this part of tour with activity or object of equal value. Partial Refunds will not be made if there is a change in tour. It is made at discretion of the tour guide and company.  

Vendors and Suppliers

Each of the Company’s vendors and suppliers who provide services as part of the Booking are carefully selected, independent entities and are not agents, employees, contractors, servants, partners, or joint ventures of the Company. You agree that the Company is not responsible for any liability caused directly or indirectly (e.g., errors, warranties, representations, breaches, negligence or omissions) by any vendors or suppliers or any other party or occurrence not under the Company’s sole control.  

Published Information

Information, prices and availability are published in the Company’s owned and controlled website but remain subject to change without notice. You agree that the Company is not responsible for any typographical errors or Itinerary errors or changes listed on the Company’s owned and controlled website or any content of an itinerary.  

Conflicts Between Terms and Conditions, Tour Date Request Form and Itineraries

If there are any conflicts between these Terms and Conditions, the Tour Reservation Form, and the Itinerary, these Terms and Conditions shall apply. If any provisions of these Terms and Conditions or any parts thereof are found to be unlawful, invalid, or unenforceable, then that provision or part thereof shall be deemed severable and struck from these terms and shall not affect the validity and enforceability of any remaining provisions, which shall remain in full force and effect. No employee, agent or representative of the Company has the authority to modify, waive, or alter any provision of these published Terms and Conditions.  

Physical Capacity for Participation

All guests must have the physical capacity to participate fully in the Company’s tour without any assistance from the hosts or other guests. Any important health, diet or disability (physical or mental) issues must be made known to the Company in writing or on the Traveler Information Form. The Company reserves the right to decline any person a Booking if it believes that it is not possible to guarantee the welfare of that person during the tour. A Booking may be refused or cancelled after the deposit or the full payment has been made. In such cases, the deposit amount or full payment shall be refunded less any transaction/cancellation fees incurred. It is necessary to be able to walk well to visit and enjoy the natural attractions of the Georgian countryside and the historic centers of the Georgian towns and villages. You should be able to walk or stroll for periods up to an hour, with short breaks. With outdoor walks within the National Parks, there is always the option to remain behind where an alternative activity will be suggested for you. The Company’s objective is to always ensure an enjoyable experience for you. You are always welcome to take time off from the scheduled activities whenever you like. Due to the nature of the winding mountain roads in Georgia, it is advisable to consult your health professional if you suffer from motion sickness of any kind. No refund shall be given for any pre-booked accommodation, transportation, guided tour or other pre-booked services or other travel that is not utilized. The Company shall make reasonable efforts to accommodate the needs of all our Guests; however, travelers requiring special assistance for their personal needs must notify us at the time of Booking for a determination of what assistance can be reasonably provided. In cases where we cannot accommodate a Guest’s special needs, persons requiring this assistance must be accompanied by a companion who shall independently provide the needed assistance. In no instance shall contracted vendors or suppliers or the Company’s personnel physically lift or assist clients on to or off of transportation vehicles.  

Medical Authorization and Coverage In the event participant becomes sufficiently incapacitated as to be unable to direct his or her own care, there is no one on the tour who can direct participant’s care, and the Company is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for the tour, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a duly licensed physician deemed competent to render the necessary care. In addition, the participant certifies that they have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.  

Minimum Group Number for Group tours

It is the Company’s objective to make this trip an intimate experience within Georgia. As such, the number of guests will always be limited. The Company shall determine a minimum number of guests for each tour. If the minimum number of guests is not reached, the tour may be cancelled and any monies prepaid shall be refunded.  

Baggage Requirements

We recommend no more than 1 suitcase (roller wheel type) plus one backpack per person.  

Publicity Permission

The Company may request a worldwide, royalty-free license of you to use digital media and data (e.g., digital reviews or testimonials, photographs, video, or digital likeness of you) solely for our promotional and/or commercial purposes. However, you shall agree to any use of such media or digital data developed by the Company prior to any promotional and/or commercial use by the Company.

CleverDever Adventures and its designated tour operator and tour leader reserve the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a Booking on a CleverDever Adventure, the participant agrees to allow his/her likeness to be used by the Company, CleverDever Authorized-authorized third parties, and the tour operator without compensation to the participant. If the guest prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the tour. Copyright in all photographs, video, and related materials created by the guests shall belong to the guest upon creation. The guest grants to CleverDever Adventures a non-exclusive, worldwide, irrevocable license to use any tour materials provided to CleverDever Adventures and/or the tour operator in any media for the following limited purposes: editorial use, promotion of this editorial use, or the promotion of CleverDever Adventures. No video may be taken or posted online of Juliana Dever aka CleverDever at any time without her express permission beforehand.  

Claims and Liabilities

The Company relies on the principles of the International Conventions, which may apply to the services provided by Company, our vendors, suppliers or agents with respect to any claim or any nature brought by you against the Company as a result of the provision of those services. International Conventions which apply may include: the International Convention on Travel Contracts (CCV Brussels, April 23, 1970), the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels and the California Travel Consumer Restitution Corporation. We will defer to these conventions with regarding any limitations on liability in relation to any claim for death, injury, loss, damage and delay to passengers and luggage. In no event, shall the Company be liable for other than compensatory damages and you hereby waive expressly and knowingly any right to incidental, consequential, and punitive damages. You agree to indemnify and hold the Company harmless from and against any costs, damages, losses, or liabilities arising out of your or your family’s or your companions’ own acts of negligence.  

Governing Venue

Any action or claim at law or in equity arising out of or relating directly or indirectly to the Booking and to these Terms and Conditions shall be governed by the laws of the Republic of Georgia without regard to any conflict of law’s provisions. You agree to file any such action or claim only in the courts located in Tbilisi, Georgia and you hereby agree to such venue and consent and submit to the personal jurisdiction of such courts for the purposes of litigating any action or claim.  

Complete Agreement

The Terms and Conditions detailed herein contain the entire understanding and Agreement between you and the Company. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
